The Pain and Healing Institute ("PHI," "us," "we," or "our") operates the [https://painandhealing.com](https://painandhealing.com) website (the "Service"). This page explains how we collect, use, and disclose information when you use our Service, and the choices you have regarding that information.

By using the Service, you agree to the collection and use of information in accordance with this policy.

### A Note on Medical Information

This website is an informational and educational resource. The personal information collected through this website is limited to basic contact details you choose to share with us, such as through a consultation request or contact form, along with the website usage and device information described below.

Protected health information and medical records created in the course of your care as a patient are handled separately, through our practice's clinical systems, and are governed by applicable healthcare privacy laws, including HIPAA. This website Privacy Policy does not govern that clinical information. If you have questions about how your medical records are handled, please contact our office directly.

### Information We Collect

**Personal information you provide.** When you contact us or request a consultation, we may collect information such as your name, email address, and phone number.

**Usage and device data.** We automatically collect information about how you access and use the Service, such as your IP address, browser type, device identifiers, the pages you view, the time and date of your visit, and similar diagnostic data.

**Cookies and tracking technologies.** We use cookies, pixels, tags, and similar technologies to operate the Service, remember your preferences, support security, analyze how the Service is used, and support our marketing. You can manage these through our cookie consent tool, and you can instruct your browser to refuse cookies, though some portions of the Service may not function properly as a result. See "Advertising and Analytics Technologies" below for more detail.

### How We Use Your Information

We use the information we collect to:

- Provide, maintain, and improve the Service
- Respond to your inquiries and provide customer support
- Notify you about changes to our Service
- Understand how visitors find and use our website
- Measure and improve the performance of our marketing
- Detect, prevent, and address technical and security issues
- Comply with our legal obligations

### Advertising and Analytics Technologies

We use third-party advertising and analytics technologies on this website, including pixels and tags from platforms such as Meta (Facebook and Instagram), LinkedIn, and TikTok, as well as analytics services such as Google Analytics and others. These technologies may collect information about your device and your activity on our website, including the pages you view, and may share that information with the third-party platforms that provide them.

We use these technologies to understand how visitors find and use our website, to measure the performance of our marketing, and to reach people who may be interested in our services on other platforms. Information collected through these technologies may be used by those third-party platforms in accordance with their own privacy policies.

Under California and other state privacy laws, this use of advertising and analytics technologies may be considered "sharing" of personal information for cross-context behavioral advertising. We do not sell your personal information for money.

**You can control or disable these technologies.** You can manage your preferences through our cookie consent tool and opt out of advertising and analytics cookies at any time. You can also adjust your browser settings to refuse cookies, and most advertising platforms offer their own opt-out controls. Where required by law, these technologies are activated only after you provide consent through our cookie banner, and we honor recognized opt-out preference signals such as the Global Privacy Control (GPC).

### How We Share Your Information

**Service providers.** We may share information with third-party companies that perform services on our behalf, such as website hosting and analytics. These providers may access your information only to perform these tasks on our behalf.

**Advertising and analytics platforms.** As described above, we use advertising and analytics technologies that share certain information with third-party platforms such as Meta, LinkedIn, TikTok, and Google. You can control this through our cookie consent tool and the opt-out options described in this policy.

**Legal requirements.** We may disclose your information if we believe in good faith that it is necessary to comply with a legal obligation, protect our rights or property, prevent or investigate wrongdoing, protect the safety of users or the public, or protect against legal liability.

### California Privacy Rights

If you are a California resident, you have certain rights regarding your personal information under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA). These include:

- The right to know what personal information we collect, use, and disclose
- The right to request deletion of your personal information
- The right to correct inaccurate personal information
- The right to opt out of the sale or sharing of your personal information for cross-context behavioral advertising
- The right to limit the use of your sensitive personal information
- The right not to be discriminated against for exercising your rights

**Do Not Sell or Share My Personal Information.** We do not sell your personal information for money. However, our use of advertising technologies, such as the Meta, LinkedIn, and TikTok pixels described above, may be considered "sharing" for cross-context behavioral advertising under California law. You can opt out of this sharing at any time by adjusting your preferences in our cookie consent tool, by declining advertising and analytics cookies, or by enabling a recognized opt-out preference signal such as the Global Privacy Control (GPC) in your browser.

To exercise any of these rights, please contact us using the information at the bottom of this policy. We may ask you to verify your identity before responding to your request.

### Other State Privacy Rights

If you are a resident of another state with a comprehensive consumer privacy law, including Virginia, Colorado, Connecticut, Texas, Oregon, and others, you may have similar rights, including the right to access, correct, and delete your personal information, and the right to opt out of targeted advertising and the sale of your personal information. To exercise these rights, please contact us using the information below. Where you have the right to opt out of targeted advertising, you can do so through our cookie consent tool and the controls described above.

### Your Rights Under the GDPR

If you are located in the European Economic Area (EEA), you have certain data protection rights, including the rights to access, correct, delete, restrict, object to, and port your personal information, and to withdraw consent where we relied on it. To exercise these rights, please contact us. You also have the right to lodge a complaint with your local data protection authority.

### Data Retention

We retain your personal information only as long as necessary for the purposes described in this policy, to comply with our legal obligations, resolve disputes, and enforce our agreements. Usage data is generally retained for a shorter period, except where it is used to strengthen security or improve functionality, or where we are legally required to retain it longer.

### Data Transfer

Your information may be transferred to, and maintained on, computers located outside of your state, province, or country, where data protection laws may differ. If you are located outside the United States and provide information to us, please note that we process it in the United States. Your use of the Service and submission of information represents your agreement to this transfer. We take all steps reasonably necessary to ensure your information is treated securely.

### Security

We take reasonable measures to protect your personal information. However, no method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee absolute security.

### Links to Other Sites

Our Service may contain links to sites we do not operate. We are not responsible for the content or privacy practices of those sites, and we encourage you to review their privacy policies.

### Children's Privacy

Our Service is not directed to anyone under the age of 18. We do not knowingly collect personal information from children under 18. If you believe a child has provided us with personal information, please contact us, and we will take steps to remove it.
